Please read the terms and conditions carefully. Once you choose Confirm Booking, you accept the terms of use contained in this agreement which is legally binding between you and us.

1. Booking Conditions:

HotelSeeker.com.au has very simple and concise booking policy and by booking accommodation on our site, you expressly agree to the following terms:

a. Cancellation Policy

All booking cancellations will forfeit the 5% deposit and $1.50 booking fee. A $10 cancellation processing fee will also apply in this instance if request for cancellation is made through HotelSeeker.

If you have been charged the balance by the Accommodation Provider at the time of your booking then the amount charged will only be refundable if it meets their cancellation criteria (eg you cancel 48 hours prior to check-in.) Otherwise, you will not be entitled to any refund if you do not meet the conditions of their cancellation policy. If you have not been charged by the Accommodation Provider and you have not met the conditions of their cancellation policy, then they are authorised to charge any monies owed to them.

The Accommodation Provider's cancellation policy is displayed in accommodation listing page prior to confirming your booking. You will be subject to their cancellation terms once your booking is confirmed.

Cancellations can only be requested online and all requests must be emailed to bookings@hotelseeker.com.au. Cancellations can also be made by contacting the accommodation provider direct. No cancellation processing fees apply in this instance.
 

b. Amendment Policy

A $10 administration fee applies if you need to amend your booking ie room type or dates (for cancellation see clause 1.a above) within 48hrs of check in time. No administration or penalty fees apply for more than 48hrs notification.

However some Accommodation  Providers operate their own individual cancellation policy and this will be displayed prior to confirming your booking. You will be subject to their cancellation terms if you agree.

Amendments can only be requested online and all change requests must be emailed to bookings@hotelseeker.com.au. You may contact hotel direct also to make amendments of which no administration fees are incured.

c. General Policy

Prices quoted are per-room (with a maximum occupancy of two people unless otherwise stated), in Australian currency and include GST unless otherwise stated.

We display the number of rooms and the rates that Accommodation Provider advise us are available. We make an effort to ensure that this information is accurate.

You authorise us to provide the Accommodation  Provider with your credit card details. The Accommodation Provider may charge the balance owed (95% of the room rate) at the time of your booking or will hold your credit card details as security for your booking. If the latter occurs, you must make arrangements for payment directly with the Property at check-in. You acknowledge that we are not liable for any default or error on behalf of any third party (for example, a bank) in processing the debit to your credit card.

If you fail to complete any booking, or cancel it, then you will be subject to the Accommodation Providers own cancellation policy whatever that may be.

HotelSeeker.com.au reserves the right to charge your credit card for any cancellation or amendment fees due.

We do not accept the responsibility of Accommodation Provider overselling rooms or for misinformation relating to any accommodation features.

2. The Web Site Service:
   
   Please note that in providing a booking service through our Web Site, we are only acting as an intermediary service for Accommodation  Provider to post information relating to the availability of accommodation. We aim to ensure the information appearing on this website is accurate and current.
   
   
   
3. Service Eligibility:
   
   You may use our services only if you can form legally binding contracts and are over 18 years of age. We do not knowingly sell any products or services to anyone under the age of 18.

4. Web Site Use:
   
   You may only use the Web Site for your own personal use. Information. It must not otherwise be copied, published, distributed, nor commercially exploited, in any form or by any method
   
   We may, in our sole discretion, change the content of the Web Site, or our services, at any time.
     
5. Privacy:
   
   
   When you book accommodation through HotelSeeker.com.au we gather personal information from you which may include your full name, email address, telephone numbers, the postal code of your residential address, and credit card account details so that we can process your booking. It is important that information you provide for us to hold is complete, accurate and up to date.
   
   Your full name and credit card details are kept by us and passed on to the particular accommodation provider with whom you apply to make a booking, for credit card processing. None of your personal information is given out to any third parties apart from the Accommodation Provider.

6. Indemnity:
   
   You hereby agree to indemnify, defend and hold us harmless for all liability, claims, damages and costs, including our legal fees (on a lawyer/client basis), arising out of or in connection with a breach of your obligations, representations and warranties provided in this agreement. You also agree to hold us harmless for all liability, claims, damages and costs, including our legal fees (on a lawyer/client basis), arising out of or in connection with any errors, malfunctions or defects in connection with the Web Site. 

6. Termination:
   
   We may terminate this agreement immediately without notice, if you fail to comply with this agreement in any way or if we suspect that you have, will or may do so, or if we discontinue operation of the Web Site.
   
   
   
7. Entire Agreement:
   
   This agreement (including the Privacy Policy) constitutes the entire agreement between you and us and supersedes all other agreements. No other representations or warranties are made, save for those contained within this agreement.
   
   This agreement between you and us is effective immediately upon acceptance by you. This agreement may be amended at any time by us posting the amended terms on the Web Site. It is your responsibility to regularly check these amended terms. This agreement may not otherwise be amended unless signed by our authorised representative. 

8. Definitions:
   
   Unless otherwise indicated in this agreement, the following terms shall be defined for the purposes of this agreement as follows: "We" and "us" means HotelSeeker.com.au ABN 12 033 997 323) and its officers, directors, agents, affiliates, and employees; "You" means the party entering this agreement as a user of the Web Site services; "Accommodation Provider" means any party offering accommodation on the Web Site through the booking service we provide; and "Web Site" means the web site located at www.HotelSeeker.com.au
   
   
   
9. Limit of Liability:
   
   If you have a dispute with any Accommodation  Provider you release us (and our agents and employees) from any claims, demands and damages, actual and consequential, of any kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. Without limitation, this expressly includes any dispute regarding negligent, misleading or deceptive claims or statements on the Web Site. To the extent permissible by law, you also waive any rights that you may have by reason of any statute applicable at the time of the dispute
